My guess is he is holding an HK53 (in production 1975+)HK's MP5's are related, but I think based on the magazine width it must be an HK53. I doubt this is of much use as speculation goes.
The magazine looks straight to me. Straight magazines for the MP5 were standard until curved magazines were introduced in 1977. They may have been standard for HK53's when they first came out.
MP5's in .40SW also use a stright magazine, but that variat wasn't available till the 90's.
Half my books are in storage, but I may be able to find out more, if anyone cares.
Looking at his nose, it could be a photoshop. I think we can agree that doesn't make killing him any less of a good idea?

He is holding a H&K G3A6 Assault rifle.
He is definitly holding the weapon at an angle to his body, with area behind his elbow that can't be clearly seen. The angle he is holding it at would reduce the percieved length. The true length would be about 40 inches.
The biggest issue regarding the weapon size is I'manutJobs scawny hide. The weapon seems like it should be bigger in relation to him.
The G3A6 was built in Iran under license. Also the G3 rifles used in Iran at the time, had the same indentations in the fore end portion of the stock.
I believe a photo caption characterizing this weapon as an SMG is incorrect.
If I were a liberal congressman from California I would just ban the bunch of them cause they all look scary.
